SC opens debate on homosexuality, agrees to revisit 2013 ruling criminalizing it

A bench headed by Chief Justice Dipak Misra was responding to a fresh petition brought by a group of five persons of the LGBT community

"Those who haven't been and won't be harmed by this law shouldn't be allowed to restrict freedom for others by ensuring dissenters are left open to the government discrimination that has already occurred in states without protective laws like this one".

The Supreme Court on Monday paved way for a fresh round of debate on its stand on homosexuality as it agreed to revisit its 2013 ruling that had set aside a law framed in 1860 which decriminalized consensual sex among adult homosexual men.

By rejecting the cases, the top court leaves in place a federal appeals court decision that allowed the 2016 law to take effect.

The law was immediately challenged.

The decision of the apex court came during a hearing of a plea filed by LGBT community. "A section of people or individuals who exercise their choice should never remain in a state of fear". It said that it was the job of the parliament to decide on scrapping laws.

The activist Gautam Bhan said SC's reading of the right to privacy as an aspect of respect and equality, especially in the case of LGBTQ rights, was welcome.




What's the Supreme Court verdict on transgenders?

The petitions argued the state law violated the First Amendment's establishment clause by endorsing religious opposition to same-sex couples and the Fourteenth Amendment's equal protection clause by "bestowing legal privileges only on those individuals who subscribe to HB 1523's state-endorsed religious and moral beliefs". Red states and conservative legal groups tested the ruling's reach in the months following Obergefell, adopting measures that prohibit same-sex couples from collecting state marriage benefits or seeking anti-discrimination law exemptions for religious objectors like cake bakers and wedding photographers. As NPR's Camila Domonoske has reported, "many of these forms of discrimination against gay and trans people are now legal in MS, and in many other states".

Many business owners have also spoken out against the law; according to South Mississippi's Sun Herald, more business owners in the area have decried it than support it. For his part, New York Governor Andrew Cuomo issued an executive order previous year banning non-essential state travel to Mississippi.

In a similar vein, the justices are now resolving a case from Colorado, involving a Christian baker who declined to produce a custom wedding cake for a same-sex couple.

A decision in that case is expected in June.
