Court Throws Out Case to Force Raila Participate in the Repeat Election

Kenyan President Uhuru Kenyatta on Sunday led the country in national prayers, calling on Kenyans to maintain peace ahead of the October 26 repeat presidential elections.

Incumbent President Uhuru Kenyatta won August's poll, but opposition leader, Raila Odinga, went to court over alleged fraud and demanded a rerun, which he was granted.

The court hearing will occur even though Kenya's interior ministry has declared Wednesday and Thursday to be public holidays.

Kenya's Supreme Court is to meet a day before Thursday's repeat presidential elections to decide whether the polls should go ahead if a credible vote can not be guaranteed.

Hours before the shooting of the driver, Kenyan police fired tear gas and warning shots to disperse small groups of opposition protesters in downtown Nairobi.

Human rights activists have said police fatally shot 67 people since the August 8 election whose annulment by the Supreme Court opened the way to the new vote.

The petitioner can, however, move to the Supreme Court to have the matter addressed.

He spoke after the resignation of an election commissioner, who then fled the country and released a statement saying she had been threatened, although she did not say who had done so. But it alarmed some Kenyans who feared it could lead to a protracted period of political instability in East Africa's economic powerhouse, which has seen elections followed by deadly violence in the past.

But last week electoral commission chairman Wafula Chebukati said "it's hard to guarantee a free, fair and credible election".

The court will hear an urgent petition by human rights activists arguing Kenya is not ready for the vote.

His threats to boycott the election if certain conditions are not met, Mr Pkosing said, will be unlawful.

The MP said he is apprehensive that there is political conspiracy to prevent the Independent Electoral and Boundaries Commission (IEBC), as presently established, from conducting the fresh presidential elections.
