The Jeronimo Yanez Trial: Defense Rests, Closing Arguments Monday

Yanez testified Friday that Castile disregarded his commands not to reach for the gun and that he clearly saw it before he fired.

"I did not want to shoot Mr. Castile. Those were not my intentions".

Dusterhoft asked Yanez to go back prior to the shooting from his prospective.

Yanez has said he was justified in stopping Castile's auto because he resembled a suspect in a convenience store robbery, according to court documents. He did not contact dispatch.

An audio recording captured Castile telling Yanez that he had a gun in the vehicle, and Yanez telling Castile not to reach for it.

Prosecutors have portrayed Castile as being cooperative when he volunteered to Yanez early during the stop, "Sir, I have to tell you, I do have a firearm on me". Prosecutors say he acted unreasonably in killing Castile, a 32-year-old school cafeteria worker who had a permit to carry the gun.

The defense called an expert Thursday who testified that Yanez used "justifiable deadly force" in shooting Castile, who had informed him that he was carrying a gun. And he says when Castile reached for something, Yanez was justified in firing. "Those were not my intentions", he said, adding that he even reached in the auto to try and stop Castile.

The Minnesota Bureau of Criminal Apprehension noted that one of the bullets fired into the auto hit the arm rest near where Reynolds was seated.

Whether the officer saw Castile's gun has become a key issue in his trial.

During Yanez testimony, Valerie Castile, Philando's mother, could be seen comforting a crying family member.

He said the inconsistencies in his statements to the BCA were due to him "trying to fumble my way through stress".

Paulsen noted the absence of a bullet hole in Castile's shorts or bullet damage to his gun - evidence, the prosecutor said, that showed he wasn't reaching for the gun when shot.

But after a brief recess, Leary sided with Yanez's attorneys and sustained their objections to the request.

Erdman drove Yanez home in Erdman's personal vehicle the night of the shooting. "My family's faces popped up in my mind, my wife and baby girl", the 29-year-old Yanez said, his voice choked with emotion. "Why did he have to reach for it?"




Defense attorneys will continue calling witnesses Friday morning.

Erdman also gave a ride to Yanez after his BCA interview.

Dutton said Paulsen was taking Yanez's comment "out of context".

Defense attorneys then proceeded to play a squad cam video of Olson giving $40 to Reynolds after Reynolds told him that she and her daughter were hungry and did not have food.

Diamond Reynolds, the girlfriend of Philando Castile, live streamed the aftermath of the shooting on Facebook.

Their analysis different greatly from an expert who testified on behalf of the state who found Yanez's use of force "unreasonable" and "excessive" based on a variety of factors.

He holds degrees from Yale University and Harvard Law School and certification as a firearms instructor for the Federal Bureau of Investigation and the National Rifle Association.

Retired police officer Joseph Dutton, who now teaches classes on the use of force, testified he's convinced that Yanez saw the gun.

Reynolds said on Tuesday that she showed the video because she did not trust police.

He said he also visited the crime scene during the day and evening to get a better understanding of the lighting conditions Yanez would have experienced.

"Correct, but it doesn't always mean that's what he was doing", Yanez said.

He also purchased the same dark pair of Ralph Lauren shorts worn by Castile during the shooting.

Paulsen also said it was curious Kapelsohn opted to leave out Yanez's initial statement on the scene about not knowing where the gun was from his report, as well as any mention that Castile was wearing a seatbelt during the incident.

The defense team has maintained the narrative that Yanez acting reasonably given the fact that Castile had a legally permitted gun and the officer feared for his safety. After Castile told the officer he had the gun, Yanez told Castile, "OK, don't reach for it then", and, "Don't pull it out" - a response Kapelsohn described as "moderate".

Closing arguments are set for Monday for Officer Jeronimo Yanez.
