House Intel Committee Approves Subpoenas For Flynn, Cohen

Flynn had previously invoked his Fifth Amendment protection against self-incrimination in declining an earlier subpoena from the committee, which sought a wide array of documents and information related to his contacts with Russian Federation.

The House intelligence committee approved subpoenas for two individuals as a part of the ongoing investigation into Russia's role in the 2016 presidential election: former national security adviser Michael Flynn and President Trump's attorney, Michael Cohen. Trump attorney Michael Cohen had refused to voluntarily comply with an earlier informal request, but had said he'd comply with and formal subpoenas.

Democrats said that while both sides had agreed to the Flynn and Cohen subpoenas, they hadn't agreed to the others.

"If the reports are accurate, subpoenas related to the "unmasking" issue would have been sent by Chairman Nunes acting separately from the committee's Russian Federation investigation", the senior aide wrote in an email. Flynn's lobbying firm, Flynn Intel Group, was also subpoenaed, as was Cohen's firm, Michael D. Cohen & Associates.

However, Cohen said Tuesday that he would gladly testify if subpoenaed because he has "nothing to hide".

His testimony will be one of the most anticipated aspects of the Russia investigation given that Comey allegedly reported in internal memos that Trump had asked him to end his investigation into Flynn's contacts with Russian officials.




The president was reportedly referring Comey's FBI's investigation into Flynn.

And there are reports fired Federal Bureau of Investigation director James Comey will testify as early as next week for the Senate Intelligence Committee, but White House Press Secretary Sean Spicer isn't responding to questions.

Trump fired Flynn in February amid questions about whether he inappropriately talked about US sanctions against Russia with a Russian official and then misled then-Vice President-elect Pence about those talks.

The three subpoenas - to the CIA, the FBI and the National Security Agency - suggested Nunes was moving independently of the panel's main investigation into Russian meddling and focusing instead on an issue that the White House preferred. "This action would have been taken without the minority's (Democrats') agreement", said a senior committee aide, speaking on condition of anonymity.

They seek all the names that were unmasked in the classified reports.

"The identities of United States persons may be released under two circumstances: 1) the identity is needed to make sense of the intercept; 2) if a crime is involved in the conversation", said Robert Deitz, a former senior counselor to the CIA director and former general counsel at the National Security Agency.
