Passenger 'squashed' on 14-hour flight sues American Airlines

Michael Anthony Taylor 67 is suing American Airlines for $100,000 after he was crushed by two obese passengers during a 14-hour flight and left with back and neck injuries

An Australian man has sued American Airlines seeking over 100,000 dollars in compensation for getting "squashed" after being seated next to two "grossly obese" passengers during a almost 14-hour flight.

He is suing the airline because he says he asked cabin crew several times to be moved to another seat, but was denied.

According to the court documents, Taylor says that the bodies of the passengers next to him "spilt over and encroached" into his seat and had to "stand up, crouch, kneel, and lean forward" during his 14 hour flight. Thomas Jensen, Taylor's lawyer, said his client constantly asked the flight crew if he could change seats but they refused to let him; nor did they suggest any alternatives. "One each occasion, he was refused and rebuffed", Mr Jansen said.

Though Taylor said he had a window seat, he alleged that the cramped quarters worsened his scoliosis and led to back injuries and bruising to his neck.

Taylor, who already suffered spinal curvature, claims he suffered even more severe back injury and neck pain because of the uncomfortable plane ride.

Now American Airline could be facing a substantial payout as the 67-year-old is seeking more than $100,000 in damages following his injuries.

Federal regulations prohibit airlines from seating passengers in jump seats, which are reserved for trained flight attendants. Other cases made similar allegations in the past, yet airlines have yet to take adequate measures to handle such situations.

The suit was probably inevitable given the ongoing demarcation between the have's (who can afford to pay extra to be spared the ignominies of flying in today's current landscape) and have nots (the rest of us who are forced to put up or with inconveniences that airliners have trained us to believe as the norm) and the increasing chasm that has resulted.

There has been a growing concern on how airlines cram their passengers into restricted seats in order to save on space.

'This will definitely become a more persistent issue, ' he said.

This week, American Airlines announced the legroom - or seat pitch - in economy on its new Boeing Max jetliners would shrink by up to five centimetres on three rows, allowing for 172 extra seats.
